Red or Blue? Party Quiz

These Terms of Use ("Terms") are an agreement between you and Derrick Soltero ("I", "me", or "the developer") covering your use of the Red or Blue? Party Quiz app ("the App"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

If you got the App from the Apple App Store, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. If the two conflict, these Terms control to the extent Apple's EULA allows.

1. Who can use the App

The App is rated 13+ and is meant for users 13 and older. If you are under 18, please review these Terms with a parent or guardian. Some app stores or state laws may require a parent's approval before you download the App or make purchases.

2. What the App is

Red or Blue? is a quiz game for education and entertainment. Each card shows a real policy, vote, quote, or action, and you guess whether a Democrat (blue) or Republican (red) owned it. The answer card explains both parties' stances and links to a source.

The App is nonpartisan and independent. It is not affiliated with, endorsed by, or paid for by any political party, campaign, candidate, or government agency. Nothing in the App is a political advertisement, voting advice, or an endorsement of any party or candidate. Ads shown in the free version are provided by Google and do not reflect the developer's views.

3. Content accuracy and sources

I work to keep every card accurate, fair, and sourced:

• Cards are based on public records such as roll-call votes, laws, executive orders, court opinions, and official statements, or on reputable news reports.
• Every answer card shows its source and date so you can check it yourself.
• The correct answer is the party that owns the action: the sponsor, the majority that passed it, or the administration in office. Some cards are surprises, and caveats explain context.

Politics changes quickly. Laws are amended, courts rule, and candidates change positions, so some cards may become outdated, simplified, or incomplete. Election-specific cards, such as state race packs, may expire or be updated after an election. Cards summarize complex topics and are not legal, financial, voting, or professional advice. Always check the linked source for the full picture.

4. Reporting an error

If you think a card is wrong, unfair, or outdated:

• Tap Report an error on the answer card, or
• Email redorbluequiz@gmail.com with the card ID (shown on the card, such as "B09") and what you think is wrong, with a source if you have one.

I review every report and will fix, update, or remove cards that are inaccurate. I may not reply to every message individually.

5. Purchases

The App is free to download. It may offer optional in-app purchases:

• Packs: one-time purchases that unlock extra card packs, such as topic packs or state election packs.
• Red or Blue? Pro: an auto-renewing subscription that removes ads (see Section 6).

All purchases are processed by Apple or Google under their terms. Prices are shown in the App and on the store's purchase screen before you buy, and may vary by country and include applicable taxes. Purchased packs are tied to your Apple ID or Google account, not to a separate account with me.

Restoring purchases. If you reinstall the App or get a new device, tap Settings > Restore Purchases while signed in to the same Apple ID or Google account you bought with.

Refunds. Refunds are handled by Apple or Google under their policies. Request one at https://reportaproblem.apple.com (Apple) or through your Google Play order history (https://play.google.com/store/account/orderhistory).

6. Pro subscription terms

• What you get: Red or Blue? Pro removes ads for as long as your subscription is active. Any other benefits are described on the purchase screen.
• Length and price: the subscription length (for example, monthly or yearly) and price are shown on the purchase screen before you confirm.
• Payment: payment is charged to your Apple ID or Google account when you confirm the purchase.
• Auto-renewal: your subscription renews automatically at the same price and for the same length unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• Free trials and offers: if a free trial or introductory price is offered, its length and the price after it ends are shown before you subscribe. Any unused part of a free trial ends when you buy a subscription, where the store's rules provide for this.
• Managing and canceling: you can manage or cancel at any time in your store account settings:
• Apple: Settings > [your name] > Subscriptions, or https://apps.apple.com/account/subscriptions
• Google Play: Play Store > Profile > Payments & subscriptions > Subscriptions, or https://play.google.com/store/account/subscriptions
• Deleting the App does not cancel your subscription. After you cancel, Pro stays active until the end of the period you already paid for. No partial-period refunds are provided except as the store's policies or the law require.
• Price changes: if the price changes, Apple or Google will notify you as their rules require, and you can cancel before the new price applies.

7. Advertising

The free version shows banner ads and occasional full-screen ads between rounds, provided by Google AdMob. How ad data is handled, and your choices about personalized ads, are explained in the Privacy Policy. I am not responsible for the content of third-party ads or the websites and apps they link to, though I use AdMob's controls to limit ads to content appropriate for teens.

8. Acceptable use

You agree not to:

• Copy, scrape, or redistribute the App's card collection in bulk
• Reverse engineer, modify, or tamper with the App except as the law allows
• Interfere with ads, purchases, or the App's servers, or try to unlock paid content without paying
• Use the App in any unlawful way, or to harass others

Sharing individual share cards and screenshots for personal, non-commercial purposes, such as challenging friends, is welcome.

9. Intellectual property

The App, its design, logo, name, code, card text, and compilation of cards are owned by Derrick Soltero and protected by copyright and other laws. Subject to these Terms, I grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control.

Quotations from public officials, government documents, and news sources belong to their respective owners. They are quoted briefly for commentary, education, and criticism, with attribution and links. The App does not use any political party's logos or trademarks. Red and blue are used only as colors.

10. Third-party services and links

The App links to outside sources and relies on third-party services (Apple, Google, Google AdMob, RevenueCat, and Supabase). I do not control those websites or services and am not responsible for their content, availability, or practices.

11. Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. I DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY CARD IS COMPLETE, CURRENT, OR FREE OF ERRORS.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, I WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ITS CONTENT. MY TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP AND IN-APP PURCHASES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Changes to the App and these Terms

I may update, add, retire, or correct cards, packs, and features at any time. If I change these Terms, I will update the effective date and post the new version. If the changes are material, I will notify you in the App. Continuing to use the App after changes take effect means you accept them. Purchased packs that are later updated remain available to you.

14. Termination

You may stop using the App at any time by deleting it. I may suspend or end your license if you violate these Terms. Sections 3, 9, 11, 12, and 15 survive termination.

15. Governing law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Nevada, unless the law where you live requires otherwise. If any part of these Terms is found unenforceable, the rest remains in effect.

16. Apple-specific terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and me, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support.
• If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any. Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
